President signed the law that would facilitate simplification of economic conditions subject to licensing

President of Ukraine Volodymyr Zelenskyy signed Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Improving the Procedure of Licensing of Business Activity” 139-ІХ approved by the Verkhovna Rada on October 2, 2019.

The implementation of the rules of the law will help to improve the current legislation governing public relations in the field of licensing of economic activities.

The document simplifies the conditions for conducting licensed business activities; clarifies the list of licensing information to be contained in the United State Register of Legal Entities, Individual Entrepreneurs and Public Organizations, information about the availability of places of business for small groups of the population and improves the procedures for appealing the actions of licensing bodies to the The expert-appeal council.

Thus, the law defines the concept of “material and technical base”; the central executive body, which implements the state policy in the field of treasury servicing of budgetary funds, is obliged to give to the licensing authorities access to information on the payment of licenses by licensees. New sanctions for infringement in the sphere of licensing are introduced – suspension of the license in full or in part; the procedure for renewal of the license terminated by the licensing authority and the procedure for the licensee's appeal against the decision of the licensing authority to suspend the license.

The document also regulates the issue of resubmission of a license application, includes new grounds for revocation of a license and excludes such grounds for revocation as non-payment by a licensee for a license. In addition, there is a new basis for leaving the application for a license without consideration, the level of fines for violation of the legislation in the field of licensing and so on.

The Law amends the Code of Ukraine on Administrative Offenses and a number of laws of Ukraine, namely: “On Licensing of Business Activities”, “On Advertising”, “On Drugs, Psychotropic Substances and Precursors”, “On Protection of Public Morality”, “On Organization of Formation and Circulation of Credit Histories,” “On Handling Explosive Materials for Industrial Purpose,” “State Register of Legal Entities, Individual Entrepreneurs and Public Organizations,” etc.
