A new story of the Constitutional Court of Ukraine begins – President Volodymyr Zelenskyy, realizing the urgent need for radical changes in the judicial system of Ukraine, identifies this issue as one of the priorities and pays special attention to it. Among the primary and fundamental aspects in this is the change of the principles of formation of the Constitutional Court of Ukraine.
That is why the Head of State signed Decree № 365/2021 "Issues of competition for the selection of candidates for the position of a judge of the Constitutional Court of Ukraine in respect of persons appointed by the President of Ukraine", which approved Regulations on holding an open competition for the selection of candidates for the position of a CCU judge in respect of persons appointed by the President, as well as the personnel of the competition commission.
For the first time during the activity of the Constitutional Court, candidates for the position of a judge under the quota of the Head of State will be elected in a transparent competition process and without any political influence. This ensures that a new history of work begins for the Constitutional Court, which will be a model for the judiciary and will be based on the principles of legal certainty, political impartiality, transparency and systematization.
"Having started a transparent selection of judges of the Constitutional Court in an open competition with a professional and independent competition commission, we create a basis so that there can be no appointments as before, i.e. in manual or corrupt mode or those that cause distrust," said Volodymyr Zelenskyy.
The competition commission must publish on the Official website of the President an announcement of a competition for the selection of candidates for the position of a judge of the Constitutional Court for persons appointed by the Head of State, and ensure the selection of candidates on a competitive basis.
Regarding the personnel of the competition commission of seven members, it should be noted that three of them are well-known and respected international experts, and four more are leading national lawyers of Ukraine with a recognized level of competence.
"The combination of international and national experts in the commission will ensure maximum confidence in the selection procedure and ensure that all participants have equal conditions," said the President.
